Silver Square Film Lab (“Silver Square,” “SSFL,” “we,” “us,” or “our”) respects the privacy of our customers and website visitors. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit silversquarefilm.com, create a customer account, place an order, submit film, negatives, or other materials, communicate with us, or otherwise use our services.

This Privacy Policy should be read together with our Terms & Conditions. Our Terms & Conditions govern orders, film processing, scanning, Digital Scans Only services, shipping, physical and digital materials, limitations of liability, and other service-related matters. This Privacy Policy specifically governs our collection and handling of personal information.

1. INFORMATION WE COLLECT

We may collect information you voluntarily provide when you place an order, create an account, contact us, submit materials, request customer support, or otherwise interact with Silver Square Film Lab.

This information may include your name, email address, telephone number, billing and shipping addresses, order number, service selections, film format, development or scanning instructions, negative condition disclosures, shipping information, transaction and order history, communications with us, and other information you choose to provide.

For Digital Scans Only and other scanning services, we may also maintain service-related information associated with your order, such as the film format submitted, scanning options selected, handling instructions, condition notes, and information reasonably necessary to process and return your negatives.

When you visit our website, certain technical and usage information may also be collected automatically, including browser and device information, IP address, approximate geographic information, referring pages or websites, pages visited, clicks and interactions, timestamps, shopping-cart activity, and similar website usage information.

2. CUSTOMER ACCOUNTS AND FASTER CHECKOUT

If you create a customer account with Silver Square Film Lab, certain information may be associated with your account to make future purchases and checkout more convenient.

Depending on the features offered by our website platform, this may include your name, email address, billing and shipping addresses, order history, shopping-cart information, account preferences, and other information associated with your purchases.

If you choose to save a payment method and that feature is offered at checkout, payment information is handled by our website platform and/or payment processor. Silver Square Film Lab does not directly store or have access to your complete payment card number.

You may update certain account information by signing into your account. Account and order records may be retained as reasonably necessary for customer service, fraud prevention, accounting, tax, legal, and legitimate business purposes even if an account is later closed.

If you are under 18 years of age, a parent or legal guardian must place the order on your behalf or authorize your use of our services.

3. CUSTOMER FILM, NEGATIVES, SCANS, AND IMAGES

You retain ownership of the photographs, film, negatives, digital files, and other photographic content you submit to Silver Square Film Lab.

By submitting materials for development, Digital Scans Only, scanning, or other requested services, you authorize Silver Square Film Lab to handle, develop where applicable, reproduce, scan, inspect, transmit, temporarily store, and otherwise process those materials only as reasonably necessary to provide the services you ordered, perform quality control, provide exposure or processing analysis when included with or requested as part of the applicable service, deliver your files, address customer-support requests, and comply with applicable law.

Digital Scans Only involves the handling and digitization of previously developed negatives. Our team may inspect submitted negatives for format, physical condition, contamination, damage, and compatibility with our scanning equipment before or during service.

Our team may need to view photographs during scanning, quality control, troubleshooting, exposure evaluation when applicable, restoration or cleanup work included with the purchased service, or customer-support work.

We will not use customer photographs for our portfolio, website, social media, advertising, contests, promotional materials, or other marketing purposes without separate permission from the customer and, where applicable, confirmation that the customer has authority to authorize the intended promotional use.

Additional terms governing customer images, submitted materials, processing, scanning, storage, retention, contamination, and liability are contained in our Terms & Conditions.

4. HOW WE USE PERSONAL INFORMATION

We may use personal information to process and fulfill orders, match submitted film and negatives with the correct order, develop film, scan previously developed negatives, deliver digital files, return negatives and products, provide customer service, communicate regarding an order, process payments, prevent fraud and misuse, maintain customer accounts, improve our services and website, analyze website performance, measure advertising effectiveness, maintain business records, resolve disputes, enforce our policies, and comply with applicable legal obligations.

We may use service-related information to determine whether submitted film or negatives are compatible with the service purchased, safely handle customer materials, document condition or handling concerns, perform quality control, and respond to customer questions or claims.

We may send transactional communications concerning orders, payments, shipping, scan delivery, negative return, service issues, account activity, or customer-support requests.

If you separately subscribe to marketing communications, we may also send promotional communications. You may unsubscribe from marketing emails using the unsubscribe option provided in those communications.

5. PAYMENTS

Payments are processed through third-party payment providers integrated with our website.

Silver Square Film Lab does not directly store complete credit-card or debit-card numbers. Payment processors may collect and process payment information according to their own terms, security practices, and privacy policies.

Where supported, customers may choose to save payment information through the applicable website platform or payment provider for easier future checkout.

6. DIGITAL FILE DELIVERY

Scans and other digital files may be delivered by email and/or through third-party file-transfer, cloud-storage, download, or gallery services, including WeTransfer.

When WeTransfer is used, the download link may be delivered in a separate email sent by WeTransfer rather than directly inside the Silver Square Film Lab order-fulfilled email.

Digital-delivery providers may process information such as your email address, IP address, device or browser information, download activity, transfer activity, and other information reasonably necessary to provide their services.

Third-party providers maintain their own terms, privacy practices, retention practices, and security policies.

As stated in our Terms & Conditions, SSFL is not intended to serve as permanent digital storage. Unless a particular service expressly provides otherwise, scan files, working files, and download galleries may be permanently deleted 30 days after delivery.

Third-party download links may expire before SSFL’s internal file-retention period ends. Customers are responsible for downloading and maintaining their own backups of delivered files promptly after receiving them.

7. PHYSICAL NEGATIVES AND MATERIALS

Physical negatives and other materials are handled according to the retention, return, storage, contamination, and abandonment provisions in our Terms & Conditions.

For Digital Scans Only orders, SSFL may inspect negatives before scanning to determine whether they are suitable for our equipment and whether they show signs of active mold, chemical residue, excessive moisture, biological contamination, deterioration, or other conditions that could create a risk to our equipment, staff, facilities, or other customer materials.

Information regarding the condition, refusal, return, special handling, or disposal of submitted materials may be associated with the applicable order where reasonably necessary for customer service, operational, accounting, dispute-resolution, or legal purposes.

Unless a different written period applies, completed negatives or physical materials that have not been returned, designated for disposal, or placed into an applicable storage service may be retained for 30 days after order completion and may thereafter be securely discarded or recycled, subject to applicable law.

Personal information relating to an order may be retained longer than the physical film itself where reasonably necessary for accounting, customer service, fraud prevention, legal compliance, dispute resolution, or other legitimate business purposes.

8. COOKIES AND SIMILAR TECHNOLOGIES

Our website uses cookies and similar technologies to operate essential website features, maintain shopping carts and customer accounts, support checkout, understand website activity, measure performance, and evaluate advertising effectiveness.

We currently use Google Analytics together with Google Ads to measure advertising performance and conversions, including completed purchases. These providers may include our website and e-commerce platform, payment processors, analytics and advertising providers, shipping carriers, email and communication providers, file-transfer and cloud-storage services, including WeTransfer, accounting or professional advisers, and other vendors necessary to fulfill orders or operate the business.

Tuesday Coffee serves as an independent host location for SSFL’s public film drop-off. Tuesday Coffee does not process SSFL orders, payments, refunds, scans, or customer accounts on our behalf.

We may also preserve or disclose information where reasonably necessary to comply with applicable law, valid legal process, court orders, governmental requests, prevent fraud or misuse, protect customers or others, enforce our agreements, or protect the rights, property, security, or safety of Silver Square Film Lab.

If Silver Square Film Lab is involved in a merger, acquisition, sale, restructuring, or transfer of some or all of its business assets, customer information may be transferred as part of that transaction subject to applicable law.

11. SALE, SHARING, AND TARGETED ADVERTISING

Silver Square Film Lab does not sell personal information for monetary payment.

We may, however, use analytics and advertising technologies that disclose limited online identifiers or website activity to providers such as Google for analytics, conversion measurement, attribution, or advertising purposes.

Depending on the privacy law applicable to a particular customer, certain advertising-related disclosures may legally be considered “sharing,” “targeted advertising,” or a “sale” even when no money is paid for personal information.

We do not sell, license, or provide customer photographs, negatives, scans, or photographic content to advertisers or data brokers.

12. INFORMATION RETENTION

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including order fulfillment, customer service, account administration, accounting, tax records, fraud prevention, dispute resolution, enforcement of agreements, and legal compliance.

Different categories of information may therefore have different retention periods.

Photographic files and physical materials are governed by the specific retention provisions described above and in our Terms & Conditions.

Unless a particular service expressly provides otherwise, SSFL may permanently delete scan files, working files, and download galleries 30 days after digital delivery.

Unless a different written period applies, completed negatives and other physical customer materials that have not been returned or designated for disposal may be retained for 30 days after order completion and may thereafter be securely discarded or recycled as provided in our Terms & Conditions.

Customer account, transaction, payment, shipping, service history, communication, and business records may need to be retained for longer periods.

When information is no longer reasonably necessary, we may delete, anonymize, or securely dispose of it.

13. INFORMATION SECURITY

We use reasonable administrative, technical, and physical safeguards intended to protect personal information and customer materials in our possession.

We also seek to limit collection and retention to information reasonably necessary to operate our business and provide our services.

However, no website, computer system, electronic transmission, cloud-storage service, file-transfer service, shipping method, or digital-delivery system can be guaranteed to be completely secure. Accordingly, we cannot guarantee absolute security.

If a security incident occurs, we will take reasonable responsive measures and provide notifications where required by applicable law.
