These Terms & Conditions (“Terms”) govern all orders, materials, services, memberships, and products provided by Silver Square Film Lab (“Silver Square,” “SSFL,” “we,” “us,” or “our”).
By placing an order, paying an invoice, delivering or mailing film or other materials to us, or using our services, you (“Customer” or “you”) acknowledge that you have read, understood, and agreed to these Terms.
Important Limitation of Liability
Film may contain unique and irreplaceable images. If film, negatives, slides, digital media, or other customer materials are lost, destroyed, or materially damaged while in Silver Square Film Lab’s custody, your exclusive remedy is limited to:
A refund of the service fees paid for the affected film or materials; and
Replacement with a reasonably comparable quantity of unexposed film, or payment of its reasonable current retail value.
Silver Square Film Lab does not accept liability for the sentimental, artistic, historical, evidentiary, or commercial value of images recorded on submitted film. We do not compensate for reshoots, travel, lost income, lost business, production expenses, or other indirect or consequential losses.
Additional limitations and legally required exceptions are explained below.
1. Services and Order Acceptance
These Terms apply to film development, scanning, develop-only and scan-only services, push-and-pull processing, RAW-file and other add-ons, negative storage and return, Negative Club services, drop-off and mail-in orders, used cameras, film, and other products sold by SSFL.
Placing an order online is a request for service and does not guarantee acceptance. An order is accepted when SSFL receives and logs the materials, confirms that they can be serviced, and receives all required payment and information.
We reserve the right to refuse or cancel an order that contains unsupported, unsafe, unidentified, incorrectly ordered, or otherwise unsuitable materials. If we cancel an unperformed service, we will refund the unearned service fees.
If a product description, membership description, written estimate, or separate written agreement contains terms that conflict with these Terms, the more specific written term will control for that particular product or service.
2. Customer Responsibilities
You are responsible for selecting the correct film type, format, development process, scan size, push-or-pull setting, return option, delivery method, and shipping address.
Every roll, disposable camera, or other submitted item must be securely packaged and clearly marked with the correct order number. You must provide enough contact information for us to match the materials to your order.
You represent that you own the submitted materials or have permission from the owner to authorize the requested services. You also represent that the submitted materials and requested work do not violate any law or infringe another person’s copyright, privacy, publicity, or other legal rights.
Film and photographs may be irreplaceable. For weddings, commercial assignments, important personal events, evidentiary work, or other mission-critical projects, we strongly recommend using reasonable redundancy, insurance, and risk-management practices.
Do not submit materials whose value exceeds the remedies provided by these Terms unless SSFL accepts a different written agreement before receiving them.
3. Orders, Payments, Changes, and Cancellations
Orders must be paid in full before processing unless SSFL agrees otherwise in writing.
Additional services, corrected order selections, special handling, return shipping, address corrections, or other customer-requested work may require an additional payment. We may hold scans, negatives, cameras, products, or other deliverables until the account is paid in full.
Once film has been received and logged, we generally cannot add to, combine, cancel, or modify the order. We will try to honor timely requests, but a requested change is not accepted unless SSFL confirms it in writing.
Film processing is irreversible once it begins.
Products or cameras may be held and shipped with completed film only when that option was selected or confirmed. Separate orders are not automatically eligible for combined shipping or refunds of duplicate shipping charges.
Prices, promotions, services, and availability may change. If a listing contains an obvious pricing or description error, we may cancel the affected item and refund the amount paid rather than provide it at the incorrect price.
4. Turnaround Times
Published turnaround times are good-faith estimates and are not guarantees.
Turnaround begins after an order has been received, logged, paid, correctly identified, and determined to be ready for processing. Business days exclude weekends, federal holidays, announced closures, and days when normal lab operations are interrupted.
Processing may be delayed by unusually high order volume, special film, equipment maintenance or failure, chemistry or supply shortages, quality-control rework, weather, utility interruption, shipping delays, illness, or circumstances outside our reasonable control.
A rush deadline applies only when SSFL accepts it in writing.
5. Film Processing and Image Results
Analog film processing and scanning involve chemical, mechanical, optical, digital, and human processes. Despite reasonable professional care, film may be scratched, fogged, stained, torn, jammed, contaminated, unevenly developed, lost, damaged, or otherwise affected.
Scanning may involve dust, cropping, frame-spacing variations, color interpretation, contrast choices, grain, scanner artifacts, file corruption, or differences between screens and prints.
Results depend heavily on factors outside SSFL’s control, including:
Camera condition or malfunction
Incorrect loading or unloading
Underexposure or overexposure
Light leaks
Film age or improper storage
Airport or security X-ray exposure
Manufacturer defects
Prior handling or chemical contamination
Incorrectly labeled film
Customer instructions
Damage that existed before we received the film
We do not guarantee that images will exist, be correctly exposed, meet a particular artistic preference, match another lab or scanner, or be suitable for a particular commercial purpose.
Blank, underexposed, overexposed, expired, fogged, light-leaked, previously exposed, mislabeled, or camera-damaged film is not evidence of a processing error. Because the requested processing work has still been completed, these results do not automatically qualify for a refund or replacement.
6. Processing and Scanning Standards
Unless SSFL accepts different written instructions, we may use reasonable professional judgment regarding chemistry, processing, density, color, contrast, cropping, frame detection, dust correction, file naming, and other technical decisions.
Minor variations in color, density, cropping, grain, dust, or frame alignment are normal and are not considered defects.
Special instructions—including push-or-pull processing, border requests, unusual scanning, cutting preferences, or nonstandard handling—must be included with the order. Special instructions may involve additional risk or charges.
We do not guarantee instructions that were not accepted before processing began.
If SSFL confirms that a delivered scan materially failed the specifications purchased because of our error, we will provide a complimentary rescan when the negative remains available and scannable.
Rescans requested because of personal preference, customer exposure, film condition, monitor differences, or instructions added after processing may be charged at current rates.
Develop-only orders do not include frame-by-frame scan inspection, exposure analysis, image-quality evaluation, or verification that usable photographs are present unless those services were separately purchased.
7. Unsupported, Damaged, or Contaminated Film
Do not submit film that is wet, moldy, leaking, chemically treated, “souped,” contaminated, severely deteriorated, self-rolled, physically damaged, or missing or damaged perforations unless you first disclose its condition and receive written approval from SSFL.
Do not submit motion-picture film, ECN-2 film, rem-jet film, or another unsupported process as C-41 or black-and-white film.
We may inspect, isolate, refuse, return, or safely dispose of materials that reasonably appear hazardous, illegal, contaminated, or likely to damage our equipment, chemistry, staff, facilities, or another customer’s film.
If you fail to disclose a hazardous or contaminated condition, you may be responsible, to the extent permitted by law, for reasonable inspection, cleaning, repair, replacement, special-handling, and disposal costs caused by that failure.
8. Tuesday Coffee Drop-Off Location
SSFL’s public drop-off location is hosted inside Tuesday Coffee at:
137 Church Street NE
Marietta, Georgia 30060
Tuesday Coffee is an independent host location. Tuesday Coffee and its employees are not responsible for SSFL orders, processing, refunds, customer service, or materials left at the location.
A drop-off is considered received by SSFL only after our team retrieves and logs it.
Film must be placed in the designated drop-off location during posted hours, securely packaged, and clearly marked with the correct order number.
SSFL is not responsible for materials left elsewhere, left after hours, handed to an unauthorized person, or submitted without enough information to identify the customer or order, except to the extent required by law.
9. Mail-In Orders and Shipping
You are responsible for secure packaging, accurate addressing, sufficient postage, and retaining tracking information for materials mailed to SSFL.
Risk of inbound carrier loss, theft, delay, or damage remains with you until the package is delivered to and logged by SSFL.
We recommend using a rigid, securely sealed package and a trackable, insured shipping service for valuable materials.
For return shipping, you are responsible for providing a complete and accurate shipping address. Once a package is tendered to the shipping carrier, carrier delay, loss, theft, misdelivery, or damage is outside SSFL’s control.
When SSFL purchases the return label, we will provide reasonable assistance with a carrier claim. Any reimbursement for a carrier-related loss is limited to the amount approved and paid by the carrier or shipping insurer.
Customs costs, duties, incorrect addresses, refused deliveries, return-to-sender fees, and reshipment expenses are the customer’s responsibility. We may require payment of those expenses before reshipping an order.
10. Digital Delivery and File Retention
Scans are delivered electronically through email and/or a third-party download or gallery service.
Digital delivery is considered complete when SSFL sends the download link or makes the files available to the email address provided with the order.
You are responsible for downloading, inspecting, and creating at least two independent backups of your files promptly after delivery.
Unless a product or membership description expressly provides a longer period, SSFL may permanently delete scan files, working files, and download galleries 30 days after delivery, without further notice.
SSFL is not a long-term archive or permanent backup service.
If digital files are lost or corrupted before initial delivery and the negatives remain available, we may recreate the scans. After successful delivery or expiration of the retention period, we have no obligation to retain or recreate files except where required by law.
RAW-file add-ons and Negative Club backup benefits are governed by their current product or membership descriptions. Storage benefits end when the applicable retention period or membership ends.
11. Negative Return, Storage, and Abandonment
You are responsible for selecting return shipping, pickup, approved Negative Club storage, or disposal when those options are offered.
If return shipping was purchased, you must provide a complete and accurate shipping address.
Unless a different written period applies, completed negatives and other physical materials that have not been returned, placed in active Negative Club storage, or designated for disposal may be held for 30 days after order completion.
After 30 days, unclaimed, unpaid, unidentified, or abandoned materials may be securely discarded or recycled without additional notice or liability, except where law requires otherwise.
If you instruct us to discard your negatives, disposal is permanent and cannot be reversed.
Negative Club storage lasts only while the applicable membership remains active and the account is in good standing. Negative Club storage is also governed by the membership benefits and conditions currently published for that plan.
Returned negatives may be cut and sleeved according to the purchased option and ordinary lab practice. Minor cutting tolerances, dust, or handling marks that do not materially impair an image are not grounds for replacement.
12. Inspection, Rescans, and Claims
Inspect delivered scans promptly. Notify SSFL in writing within 14 days after digital delivery of a claimed scanning or processing issue.
Inspect returned negatives, cameras, and products promptly. Report physical damage, missing items, shipping damage, or product defects within seven days after delivery.
These notice periods do not shorten any right that cannot legally be waived.
A claim should include:
Customer name
Order number
Affected roll, file, camera, or product
A clear description of the problem
Representative files or photographs showing the issue
Do not alter, discard, repair, or send the relevant negatives or product elsewhere before giving SSFL a reasonable opportunity to inspect and address the claim.
We may request that materials be returned at our expense before issuing a remedy. A courtesy credit, rescan, refund, or replacement does not constitute an admission of liability.
13. Refunds and Service Remedies
Service fees are generally nonrefundable after processing begins because the requested work and materials have been consumed.
If SSFL cancels an unperformed service, we will refund the unearned portion of the service fee.
If we confirm a material processing or scanning error, we may provide a rescan, reprocessing where technically possible, a refund of the affected service fee, store credit, comparable replacement film, or another appropriate remedy described in these Terms.
Shipping charges, completed custom work, completed services, and consumable products are nonrefundable except where SSFL made an error or applicable law requires otherwise.
Please contact SSFL and allow us a reasonable opportunity to address a disputed charge before initiating a payment dispute. This request does not waive any legal right.
14. Film, Products, and Used Cameras
New film, chemistry, and other consumable goods are final sale after shipment or pickup, except when an item was materially misdescribed, damaged before delivery, or applicable law requires a return.
Manufacturer warranties, if any, are provided by the manufacturer and are not expanded by SSFL.
Used cameras and lenses are sold in the condition described in their individual product listings.
Unless a listing states otherwise, a used camera serviced and sold by SSFL includes a 30-day limited functional warranty beginning on the date of delivery or pickup.
The warranty does not cover:
Previously disclosed cosmetic condition
Batteries or film
Misuse or improper operation
Impact, dropping, water, moisture, or excessive heat
Unauthorized repair or disassembly
Normal wear
A feature listed as untested or nonfunctional
For a valid used-camera warranty claim, SSFL may choose to inspect, repair, replace the item with a reasonably comparable item, or refund the purchase price after the product is returned.
The individual product listing controls if it provides a different written warranty or remedy.
15. Limited Remedy for Lost or Damaged Film
TO THE FULLEST EXTENT PERMITTED BY LAW, IF FILM, NEGATIVES, SLIDES, PRINTS, DIGITAL MEDIA, OR OTHER CUSTOMER MATERIALS ARE LOST, DESTROYED, OR MATERIALLY DAMAGED WHILE IN SSFL’S CUSTODY, THE CUSTOMER’S EXCLUSIVE REMEDY AND SSFL’S MAXIMUM LIABILITY WILL BE:
A REFUND OF THE SERVICE FEES PAID TO SSFL FOR THE AFFECTED FILM OR MATERIALS; AND
REPLACEMENT WITH A REASONABLY COMPARABLE QUANTITY OF UNEXPOSED FILM, OR PAYMENT OF ITS REASONABLE CURRENT RETAIL VALUE.
The images recorded on film may have sentimental, artistic, historical, evidentiary, or commercial value that cannot be verified or recreated. SSFL does not accept that value as part of the service and will not compensate for it.
16. Disclaimer and Limitation of Liability
Except for the remedies expressly stated in these Terms, our services and products are provided “as is” and “as available.”
To the fullest extent permitted by law, SSFL disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and warranties arising from a course of dealing or usage of trade.
SSFL is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including:
Lost income, profits, revenue, or business
Lost opportunities or reputation
Reshoot or recreation costs
Travel, talent, venue, or production expenses
Editing, printing, restoration, or third-party laboratory expenses
Loss of data after delivery
Sentimental or emotional value
SSFL’s total liability arising from an affected order will not exceed the service fees paid for the affected materials plus the reasonable current retail value of comparable unexposed film.
Nothing in these Terms excludes or limits liability for fraud, gross negligence, willful misconduct, personal injury caused by negligence, or any other liability that cannot legally be excluded or limited.
17. Image Ownership, Privacy, and Permission
You retain ownership of your photographs and submitted content.
You grant SSFL a limited, nonexclusive license to handle, reproduce, scan, transmit, and temporarily store your content only as reasonably necessary to:
Provide the ordered services
Perform quality control
Respond to customer-support requests
Deliver your files
Comply with applicable law
SSFL will not use customer images for its portfolio, website, social media, advertising, contests, or promotional purposes without separate permission.
We may use trusted payment, shipping, hosting, gallery, cloud-storage, and communication providers to perform our services. Those providers operate under their own terms and privacy practices.
We may refuse materials that appear unlawful or that reasonably create a safety, legal, or third-party rights risk. We may preserve or disclose information when required by valid legal process or applicable law.
Our separately published Privacy Policy also governs how personal information is collected, used, and retained.
18. Customer Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless SSFL and its owners, employees, contractors, and agents from third-party claims and reasonable expenses arising from:
Your lack of authority to submit the materials
Content that infringes another person’s rights
Content or materials that violate applicable law
Undisclosed hazardous or contaminated film
Inaccurate instructions or information
Your material violation of these Terms
This obligation does not apply to the extent a claim was caused by SSFL’s gross negligence, willful misconduct, or other conduct for which indemnification cannot legally be required.
19. Events Outside Our Control
SSFL is not liable for delays or failures caused by circumstances beyond our reasonable control, including severe weather, fire, flood, epidemic, war, civil disturbance, government action, shipping interruption, utility or internet outage, cyberattack, labor dispute, supplier shortage, or equipment failure despite reasonable maintenance.
We will use reasonable efforts to resume service or refund materially unperformed service fees when appropriate.
20. Governing Law and Disputes
These Terms and each order are governed by the laws of the State of Georgia, without regard to conflict-of-law rules.
Before filing a legal claim, both parties should make a good-faith effort to resolve the issue through written customer-service communication.
Unless applicable law requires another location, legal proceedings arising from these Terms or an order must be brought in a court of competent jurisdiction located in or serving Cobb County, Georgia.
Either party may use a court with lawful small-claims jurisdiction when eligible.
21. General Provisions
If any part of these Terms is found invalid or unenforceable, it will be enforced to the maximum lawful extent, and the remaining provisions will continue in effect.
A failure to enforce a provision is not a waiver of that provision.
These Terms, the applicable order confirmation, product description, membership description, accepted written instructions, and referenced policies constitute the complete agreement concerning an order.
We may update these Terms prospectively by posting a revised version and revision date. The version in effect when an order is placed will generally govern that order, except for changes required by law or separately accepted by the customer.
